Hong Kong media tycoon Jimmy Lai appeared in the city’s High Court on Monday for a mitigation hearing, the final step before his sentencing in a landmark national security trial. The 78-year-old pro-democracy activist faces potential life imprisonment after being found guilty last month.
Lai, the founder of the now-closed Apple Daily newspaper, was convicted of being the “mastermind” behind conspiracy to collude with foreign forces and conspiracy to publish seditious material under Hong Kong’s China-imposed national security law. Lai has consistently denied all charges.
The trial has drawn international attention and criticism. Governments in the United Kingdom, the European Union, and the United States have voiced concern over the verdict, while Hong Kong authorities maintain that Lai received a fair trial and that the law has helped restore stability in the city.
During Monday’s proceedings, defense lawyers presented arguments to seek a more lenient sentence, which could range from 10 years to life in prison under national security law guidelines. Lai sat in the court’s glass dock alongside eight other defendants, separated from the public by prison guards.
Prosecutors addressed concerns about Lai’s health, citing a January 9 medical report stating that his condition was “stable,” despite past reports of heart palpitations. The court heard testimony from several prosecution witnesses, including Andy Li and Wayland Chan Tsz-wah, who played key roles in providing evidence against Lai.
Jimmy Lai has been a long-standing critic of the Chinese Communist Party (CCP) and a prominent advocate for press freedom in Hong Kong. The judges concluded that Lai used Apple Daily to promote campaigns aimed at “seeking the downfall of the CCP,” even if this came at the expense of the public interest in China and Hong Kong.
The hearing attracted significant public interest, with nearly 100 people lining up outside the court, some camping out for several days in support of Lai. Many of his supporters expressed hope for his release, emphasizing their belief that he had done nothing wrong.
The case has also drawn attention from international leaders. U.S. President Donald Trump recently stated that he asked Chinese President Xi Jinping to release Lai, describing him as a “positive activist,” although he received no response.
The outcome of this mitigation hearing will set the stage for Lai’s final sentencing and could have lasting implications for media freedom and civil rights in Hong Kong. Observers say the verdict will also influence the perception of Hong Kong’s national security law and its impact on pro-democracy activists in the city.
